Privacy Policy
Introduction
The following privacy policy informs you about our practices regarding the personal information you provide to us, in compliance with Bill 25 – An Act to modernize legislative provisions respecting the protection of personal information. Bill 25 applies to all private companies and public organizations in Quebec, Canada.
By visiting our website, participating in our events, or entering into a service agreement with us, you expressly consent to process your personal information per this policy’s provisions.
1. General provisions
Under the Act Respecting the Protection of Personal Information in the Private Sector, personal information refers to any data that can identify an individual. Accordingly, confidential information is understood to mean any sensitive data or personal information whose access and use are restricted to designated persons or entities, and whose disclosure could cause harm to the organization, its partners, or individuals.
Percolab acknowledges that it will have access to personal, confidential, strategic, business, technical, or legal information related to clients, event or training participants, organizations, companies, partners, visitors, and suppliers (hereinafter referred to as stakeholders), including, but not limited to, information regarding their strategies, business opportunities, intellectual property, outsourcing agreements, and other information of a similar nature.
Percolab is therefore committed to protecting the confidentiality and security of the personal information of our stakeholders. This privacy and personal information protection policy aims to help understand the practices regarding the collection, use, and retention of personal information.
2. Applicable Laws
Percolab is subject to the provisions of the Act Respecting the Protection of Personal Information in the Private Sector (CQLR, c. P-39.1) when such information is held in the course of its functions and activities.
3. Collection of Information
Personal information is collected in several ways, including through business-related forms, data transfers into our databases, and communications with us in person, by telephone, by mail, or by email. Percolab only collects the personal information necessary for the conduct of its activities and for the achievement of its specified purposes.
Depending on the circumstances, personal information may include business and organization identifiers, employee identifiers, payment management information, strategic or contractual information of an entity, and similar data.
4. Use of Information
Measures have been implemented to ensure that only authorized individuals have access to personal information and are permitted to process the data. Accordingly, a non-disclosure agreement must be signed in advance by all Percolab employees, interns, contractors, and/or subcontractors who have access to IT systems and confidential data. Furthermore, no data will be transferred to a third party without the written approval of the stakeholder.
Percolab acknowledges that confidential information remains the exclusive property of the stakeholders and that any unauthorized disclosure of such confidential information may cause significant harm. To protect the interests of the stakeholders, Percolab will use the disclosed confidential information solely for the purposes for which it was provided. All stakeholder data remains confidential unless it has been made public through the media or by the stakeholders themselves.
A document is considered non-confidential if:
- It contains no personal information and has no strategic value for the entity;
- At the time of its disclosure, it was already in the public domain;
- After the transfer of information between the stakeholders and Percolab, it becomes generally available to the public through publication or otherwise, and such disclosure is not the result of any fault on the part of Percolab;
- It is disclosed to Percolab by a third party;
- It constitutes government information.
The information collected is used for the following purposes:
- To record confidential data in our databases;
- To save changes made in the database;
- To develop public consultation projects;
- To manage our operations and human resources;
- To manage our events;
- To provide specialized services in the field of socio-ecological transition.
5. Storage of Information
Percolab retains personal information of the stakeholders for as long as necessary to provide its services, or as required by applicable laws, regulations, or government orders. Personal information may be retained for different periods depending on the nature of the information and the reason for which it is held. By using services from Percolab, stakeholders consent to the transfer of personal information to its database. Percolab never sells personal information to third parties, and written authorization is required before transferring confidential information from a stakeholder to a third party.
Percolab has implemented appropriate physical, technological, and administrative safeguards to protect the confidentiality and security of personal information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access, misuse, or any other form of illegal processing of personal information in its possession.
However, no method of Internet transmission or electronic storage is completely secure. If you have reason to believe that the confidentiality of personal and/or confidential information has been compromised, please contact us.
Percolab is committed to promptly taking all necessary actions to limit any harm that may result from a privacy breach, investigating to identify any vulnerabilities, and implementing the necessary corrective measures to prevent the recurrence of such an incident.
6. Updates
The content of this policy may be amended without notice to reflect changes to our practices, technologies, legal requirements, and other factors. Any changes to this policy will take effect immediately. We therefore encourage stakeholders to stay informed about how Percolab handles personal information.
